1. Agreement to Terms
By accessing or using the Crude Intelligence Report website (crudeir.com) or subscribing to any CIR newsletter or publication, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
2. Description of Services
Crude Intelligence Report ("CIR," "we," "us," or "our") provides independent upstream oil and gas market intelligence, including website content, newsletters, and analytical reports (collectively, the "Services"). CIR is an independent publication and is not affiliated with any oil and gas company, financial institution, or government agency.
3. Not Investment Advice — Critical Disclaimer
THE CONTENT PUBLISHED BY CRUDE INTELLIGENCE REPORT IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING ON THIS SITE OR IN ANY CIR PUBLICATION CONSTITUTES INVESTMENT ADVICE, FINANCIAL ADVICE, TRADING ADVICE, OR A RECOMMENDATION TO BUY, SELL, OR HOLD ANY SECURITY, COMMODITY, OR FINANCIAL INSTRUMENT.
CIR is not a registered investment advisor, broker-dealer, or financial planner. The information provided is based on publicly available data, company filings, regulatory data, and CIR's own analytical opinion. It may contain errors, omissions, or outdated information. 4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- CIR shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Services.
- CIR's total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid to CIR in the twelve (12) months preceding the claim.
- CIR shall not be liable for any loss of profits, loss of data, loss of goodwill, or any reliance on information provided by CIR.
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if CIR has been advised of the possibility of such damages.
5. Subscriber Accounts and Subscriptions
5.1 Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify CIR immediately of any unauthorized use of your account.
5.2 Subscription Terms. Paid subscriptions are billed on a monthly or annual basis as selected at the time of purchase. All fees are in U.S. dollars. Subscriptions automatically renew unless cancelled before the renewal date.
5.3 Refund Policy. Subscriptions are generally non-refundable. If you believe you have been charged in error, contact us within 30 days of the charge.
5.4 Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid content through the end of your paid period.
6. Intellectual Property
6.1 CIR Content Ownership. All content published by CIR — including articles, analysis, newsletters, graphics, and data compilations — is the exclusive intellectual property of Crude Intelligence Report and is protected by U.S. copyright law.
6.2 Subscriber License. Your subscription grants you a limited, non-exclusive, non-transferable license to access and read CIR content for your personal, non-commercial use only.
6.3 Prohibited Uses. You may not: - Reproduce, distribute, or republish CIR content in any medium without express written permission - Share your subscription access with others - Scrape, crawl, or systematically extract CIR content - Use CIR content for commercial purposes without a commercial license - Create derivative works based on CIR content without permission
Violations may result in account termination and legal action. CIR actively monitors for unauthorized reproduction of its content.
7. Accuracy of Information
CIR makes reasonable efforts to ensure the accuracy of information published, including use of primary sources (SEC filings, EIA data, Baker Hughes rig count data, company press releases) and clear attribution of third-party estimates. However, CIR does not warrant that all information is accurate, complete, or current. Information may contain errors or may become outdated after publication.
Where CIR expresses analytical opinions or forward-looking assessments, these are clearly labeled as "CIR Analysis" or "Editor's Take" and represent opinion, not fact.
8. Acceptable Use
You agree not to use the Services to: - Violate any applicable law or regulation - Transmit spam or unsolicited communications - Interfere with or disrupt the Services - Impersonate CIR or any CIR contributor - Engage in any activity that could harm CIR or its reputation
9. Third-Party Links and Sources
CIR may reference or link to third-party websites, publications, or data sources. These links are provided for convenience and informational purposes only. CIR does not endorse, control, or assume responsibility for third-party content. Your use of third-party sites is subject to their own terms and privacy policies.
10. Privacy
CIR's collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as described in our Privacy Policy.
11. Modifications to Terms
CIR reserves the right to modify these Terms at any time. We will notify subscribers of material changes via email. Your continued use of the Services after notification constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Houston, Texas. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CIR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
